Our goal is to raise awareness about mental health, address rising challenges in this area, and create fun, meaningful offline interactions. Before you embark on your journey with us, please take the time to read and understand our Terms of Service and Privacy Policy. By using Wander's services, including the Wanda bracelet, you agree to comply with these terms and policies. If you do not agree with any part of these terms, we kindly ask you to refrain from using our services.

1 - Acceptance of Terms

1.1 - These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Wander Place ("Wander Place," "Wander," "we," "us," or "our"). By accessing or using the Wander Place website, or any services provided by Wander Place (collectively, "Services"), you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use Wander Place.

2 - Registration

2.1 - You agree to provide accurate, current, and complete information during the registration process and to keep your Account information accurate, current, and complete.

2.2 - To utilize our Service, you must be a minimum of 18 years old, and by doing so, you affirm to us that you meet the age requirement.

2.3 - Our Service is inaccessible to any users who have been previously excluded from our platform.

2.4 - When you sign up, you'll be asked to provide your phone number. By doing so, you explicitly agree that we may contact you at that number using any suitable methods. If you're not comfortable with this, reach out to us, and we'll delete your account. Message and data rates apply, and we are not responsible for any delays in sending or receiving text messages.

2.5 - When you sign up, you'll also be required to provide your email address. By doing so, you consent to us using that email address to send you notices related to our Service, instead of communication by postal mail. If you prefer not to receive such emails, contact us, and we will delete your account.

3 - Use of Wander

3.1 - Wander is intended for personal use to facilitate authentic human interactions. You agree not to use Wander for any unlawful or prohibited purpose.

3.2 - You must adhere to our Community Guidelines, which are an integral part of these Terms. You agree to behave respectfully and considerately toward other users and to follow our guidelines for appropriate conduct.

3.3 - Wander may offer features or services that require payment. If you choose to use these paid features or services, you agree to the pricing and payment terms provided at the time of purchase.

3.4 - You are responsible for your engagements with other Users on our Service – it's not our responsibility, it's yours. While we may, at our discretion, opt to assist, we are not compelled to oversee interactions between Users or address disputes or other matters.

4 - Disclaimer

4.1 - Wander is provided "as is" and "as available" without any warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

4.2 - Wander serves as a social catalyst designed to connect like-minded individuals. Participation in events and wearing the Wanda bracelet is entirely voluntary and at your own discretion.

4.3 - Wander shall not be held responsible for the outcomes of interactions facilitated through its platform, which may include friendships, relationships, or any other form of connection.

4.4 - Please note that the Wanda emblem may present a choking hazard and should be kept out of reach of children.

4.5 - You have the option to provide us with comments or thoughts about our Service (collectively, “Feedback”). If you choose to give us Feedback, you represent and warrant that you have all the necessary rights to grant, to us a non-exclusive, perpetual, irrevocable, transferable, royalty-free, and worldwide license. This license includes the right to grant and authorize sublicenses, allowing us to implement, use, modify, and otherwise exploit such Feedback without any restrictions, fees, attribution, or other obligations to you or any third party.

4.6 - We do not provide any warranty, endorsement, guarantee, or assume responsibility for any product or service advertised or offered by a third party through our Service, including in connection with any events.

5 - Limitation of Liability and Indemnification

5.1 - To the fullest extent permitted by applicable law, Wander shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of Wander.

5.2 - Wander disclaims any liability for damages, injuries, or losses resulting from the use of our website, product, or participation in events.

5.3 - By using Wander's services, you agree to indemnify and hold Wander, its affiliates, employees, and partners harmless from any claims, losses, or liabilities arising from your use of Wander services.

6 - Allergies and Health Complications

6.1 - The Wanda bracelet is meticulously crafted from a magnesium & aluminum alloy, polyester and nylon. Allergic reactions to these materials are uncommon. Nonetheless, if you notice any signs of allergies or health issues while wearing the bracelet, we highly recommend seeking advice from a healthcare professional promptly. Please note that we are not liable for any such complications, regardless of their extent, that may arise.

7 - Changes to Terms of Service:

7.1 - Wander reserves the right to modify these terms at any time. Your continued use of our services implies your acceptance of any updated terms.

8 - Legal Compliance and Openness to Others' Views

8.1 - Wander users are required to adhere to all relevant regulations and statutes of the state of California and the federal government of the United States while using our services.

8.2 - We encourage open and respectful interactions among users. Discriminatory, illegal, or harmful behavior will not be tolerated.

9 - Intellectual Property

9.1 - All content and materials on Wander, including text, graphics, logos, icons, images, audio, and software, are the property of Wander or its licensors and are protected by intellectual property laws. You may not use, reproduce, or distribute any content from Wander without our prior written consent.

10 - Termination and Cooperation in Legal Matters

10.1 - In cases of contradiction with these terms, Wander reserves the right to terminate your usage of our services.

10.2 - Wander reserves the right to terminate or suspend your Account and access to Wander, with or without cause, at our discretion.

10.3 - Wander will fully cooperate with official parties in legal matters, should such cooperation be required.

11 - Fees and Payments

11.1 - To access our Service, fees are required. For instance, the purchase of your Wanda bracelet or payment of an attendance fee for our events is necessary. Unless otherwise agreed in writing at our sole discretion, all fees paid are non-refundable.

11.2 - Payment must be received before any obligation on our part to provide the paid segments of our Service.

11.3 - When making payments, you consent to the sharing of your payment information with our third-party payment service provider, Stripe, Inc. ("Stripe").  Refer to Stripe’s Services Agreement and Stripe’s Privacy Policy at https://www.stripe.com for details on how Stripe collects and utilizes personal information.

11.4 - We reserve the right to modify our fees, fee-based aspects of our Service, and payment terms at our discretion. Generally, refunds are not granted for payments unless explicitly agreed upon in writing or required by applicable law.
